What can be done if neighbour is not giving any parking space

Hi I am residing in DDA flats in delhi. It is not a gated society and even there is no RWA in our area. One flat owner owns 8-10 cars he is a travel agent and he parks all his commercial cars in space available for other residents l. Pls advice what should i do

You can file a complaint to the concerned SHO for the removal of illegal encroachment on the public property and you can also give an application to the SDM of the concerned area and they will efficiently deal with it, . In case you do not get the instant remedy from the concerned official you may also file a suit for permanent injunction and ask the court to intervene in the matter through the SDM or SHO of the particular area.

You can start by sending him a legal notice for restraining from using the common public area. If he doesn't budge then you can file a suit for declaration in the court. You will seek a declaration that the said area is a public area. In the meantime, that is while the suit is going on. You can ask for an interim relief of injunction. That will ensure that till the suit is finally decided the person cannot park his cars in that area.

Dear sir in such a case first of all you can bring all the people together and make a RWA and file a injunction suit against that person and if no RWA can be formed then simple any one can file a case of injunction against that man and duly accompanied by the resolution signed by all the neighbours and residents restraining the man from doing so.

Hello,
Is it your own parking space? Or a road where he parks his car regularly?
If it is your own parking space then you can file a case anytime. With the help of other residents, I hope they are suffering the same.

If there is no RWA in that case you can get along with 3-4 other flat owners and can raise a complaint against the same you can even go ahead and file a civil suit for Declaration/Damages and injunction seeking your and other rights that are being inferred.
