What are the stamp duty and registration charges in Kolkata for gift deed of house from wife to husband? Also want to know if husband takes home loan for wife but not owner or co-owner of the property, can he claim for tax benefits of home loan?

The stamp duty and registration depends where the property is situated,as West Bengal is divided in 3 categories and also the rate depends at the circle rate of the property. Compared to normal stamp duty and registration charges. Iit will be quite less.

Now, the answer to your second question “yes” the husband/ wife can claim tax benefits of the home loan, the condition is only one spouse should claim benefit. Not both of them.. for further information contact lawrato.

If you are in municipal area the the Stamp duty will be 0.5% and registration fee will be 1% of the market value of your property in case of Gift Deed.
The conditions for taking tax benefits:-
1.You must be a co-owner in the property
2.You must be a co-borrower for the loan

For gift-When made to a member of the family,-0.5% Stamp duty of the market value of the property.Registration charge 1.2% of the market value.please pay a visit in the office of the concerned Sub Regisrar and get the detail information.
For obtaining IT tax benefit for HBL, only property holder who got the HBL can claim
