we wan to sell a plot which on my deceased fathers name

what certificate I need to have to sell the property , how to make them, we are 2 sibling (me and my brother) and my mother all of us are in agreement to sell. And buyer want to take loan on property so can he able to do that

You need to file a declaratory suit for partition and title before civil judge senior division for getting property named in favour of you and sibling . You, your brother , your mother vs estate of your late father will be the regular suit and you shall get the decree within 5-6 months in your favour and then you can legally proceed to sell the land.

Firstly you have to apply family members certificate. Then apply for mutation in municipal corporation and development authority also if plot based in agricultural land then you have to mutate in tehsil record

Yes you all can definately has the power to sell as under the Indian succession act after the death of the father the ownership succeeded to the sibling but if any will has been contested by the father or any conditions lies then its not possible but if there is not then you can sell and buyer can also take loan
