We have a family property dispute in Bangalore

25-Sep-2023 (In Property Law)
Our family property was transferred to one of my brother for housing loan since he was a bank emp and planned each will stay in one floor after construction he fell ill and had Brian surgery during that time one of my sister had taken a finger impression on blank papers (2001)and converted into her name by 2002 my brother died. until 2015 we didn't know about property name change since my daughter wanted a separate room so we asked my sister to move into separate floors then they fought with us and now they are demanding that property belongs to them. I'm writing this query on behalf of my mom Please any suggestions.

If You have proof showing the said property was a family property then you can claim it back from your sister. you say that you are all still living in the same house. What papers you have with you ? you may need to get some papers to start legal action.

You file a suit in civil court for claiming the disputed property. You can file a private complaint in the court. Because at the time of your brother 's sickness she might have taken the impression on the documents and got the transfer of the disputed property

Family property means whether ancestral or self acquired of your father you have not mentioned ? When your sister got married ? whether your father executed any Will or Gift Deed if it is self earned property has to be clarified ? When on what date she has taken finger print on blank papers ? If it is in hospital when he had gone for brain surgery then it is not acceptable under which your can prove before court once you file suit against your crooked sister. So many points has to be discussed so please come with documents and meet us through law ratto team.
