Want to my share in Father's Property share

We are seven brothers and one sister. We living separately with our family in Bagnan, Howrah. My father and mother died almost 10years ago. But all property like House, Land, shop etc belong my father till not not divide. I am the 3rd son. We all 6brother and one sister want to share the property and sell this property because of bad financial condition , but my one rich brother is not ready to devide the property and sell nor willing to give me my share. What can be done pls. advise

You have to ask your brother for partition of property and you may also issue legal notice to your brothers and sisters for partition of property. If they don't want to do it then you have to file a suit for partition of property.

With reference to your query , the first issue is whether the property is self acquired by your deceased father or he had inherited the same.If it a self acquired property, whether the same testate or intestate property?I wish to peruse all documents and after having a knowledge about the status of the property I can render professional advice to you.Should you require my professional assistance contact lawRato for instructions.

Dear querist,
There are three ways you can go about it
1.Partition suit is the way forward in your local district court or in high court which will entirely depend on the property value, personally I feel high court orders are faster but it’s expensive
2.or you all can sell your undivided share in property to your rich brother asking for a little less than what you expect from individual...
3. Wait till you brother give consent to your proposal...
There are others ways too but Here on a public forum I cannot share to you how???
