We have a ancestral house in village in which currently residing my real elder cousins brother family my father moved from this house to city in 1997 and my birth was of this house in 1989. This house recorded in revenue record khatauni as Abadi bhumi, so how I get to know the ownership details and how can take legal entry at present and stop them to make any construction at present.
Since the property is recorded as Abadi Bhumi, ownership is not decided only by possession. First, obtain revenue records such as Khatauni, Khasra, Abadi register, family register (Parivar Register) from the Lekhpal/Tehsil to see in whose name the house is recorded and on what basis. Also collect old documents, tax receipts, electricity/water connections, and any partition or family settlement, if available.
If the house is ancestral and no legal partition has taken place, all legal heirs have a joint right. Mere residence of elder cousins does not make them exclusive owners. You may file an objection/application before the Tehsildar/SDM for correction/verification of entries and seek certified copies.
To stop construction, you can issue a legal notice and file a civil suit for partition and permanent/temporary injunction before the civil court, requesting a status quo or stay order against construction till rights are decided. Immediate court intervention is the proper remedy.
