29-Oct-2026 (In Property Law)
My relative was allottee of municipality tahabazari/rental shop since 1996 and died during the year 2011. The rent of above shop was paid by legal heirs to the municipal committee on montly basis regularly. Now, they wants to transfer the said shop on the name of all legal heirs. what is the procedure, required documents and provide the details of rules/regulation under which said shop may be transfer in favour of the all legal heirs of the deceased allottee.

Hi, thank you for your query. You may apply to the concerned Municipal Committee for substitution of the deceased allottee's name in favour of the legal heirs. Since the shop was allotted under a tahabazari/rental arrangement, the transfer will depend on the applicable municipal policy and the original allotment conditions; joint transfer to all heirs cannot be assumed automatically. The application would generally require the original allotment letter, death certificate, legal-heir certificate, rent receipts, identity documents of the heirs, and NOCs or affidavits wherever required. The applicable rules must be identified before determining whether all legal heirs can be recorded jointly and whether any specific fees or additional formalities apply. For further legal assistance with the transfer application and identification of the applicable municipal rules and regulations, you can contact us.
