Sold land long ago, can I get a farmers certificate and buy farm land

My brother and I had ~8000sqft each of agricultural land in Pune, that we held jointly with our Mother. Totally about 16000sqft. We sold the plots in 2005. I want to buy farm land in Maharashtra now. Am I eligible to buy farm land in Maharashtra now, 21 years after we sold our land? I've got the digitally signed 7/12 and 8a from the mahabhumi portal, as well as copies of the mutations with our names on it. My Mother passed away 4 years ago. I want to buy agricultural land to do some farming.

difficult. usually the time frame is 3 years within which should buy new agricultural property to retain your farmer status. however, you may still approach the Collector with your details and seek permission to buy agricultural property now.

Under the Maharashtra Tenancy and Agricultural Lands Act, agricultural land in Maharashtra can generally be purchased only by a person who qualifies as an “agriculturist.” Since you and your brother earlier held agricultural land jointly and your names were reflected in the 7/12 extract and mutation entries, you may still qualify as a person from an agriculturist family. The fact that the land was sold in 2005 does not automatically extinguish your status, especially if documentary proof establishes prior holding and cultivation lineage.

If your name was recorded as agriculturist in 7/12 earlier, you remain eligible to buy agricultural land in Maharashtra. Keep old 7/12, 8A and mutation entries as proof while executing new purchase deed.

Yes. As you earlier held agricultural land and have 7/12 & mutation entries, you qualify as an agriculturist in Maharashtra. You can purchase agri land, subject to local ceiling limits and NA restrictions. Verify title.

Under the Maharashtra Tenancy and Agricultural Lands Act, only an “agriculturist” can purchase agricultural land unless prior Collector’s permission is obtained. Since your name earlier appeared on 7/12 extract as holder of agricultural land, you can claim status as agriculturist, even if the land was sold in 2005. There is no time limit that disqualifies you merely because you sold the land years ago. Keep certified copies of old 7/12, 8A and mutation entries showing your name. These documents are normally accepted as proof of agriculturist status. Before purchase, verify zoning, ceiling limits and ensure the seller has clear title. Registration must be done with proper recital of your agriculturist status. If any doubt arises, you may obtain a formal certificate from the Tahsildar.
