Sir, my mother excuted gift deed to my younger brother & his son & brother in law on xerox papers in a sro off. Is it vallied?

gift deed to your younger brother and his son and brother-in-law...is your property and ancestral or the property she gave as gift is her own or is it your father's property where she acquired as succession there are so many consideration to say exactly whether on that property they have any right you can contact me if we have to file a case...let me know

No, such a “gift deed” is not legally valid. A gift of immovable property must be executed on proper stamp paper and compulsorily registered before the Sub-Registrar under the Registration Act. Execution on plain/xerox paper, even if done in an SRO office premises, has no legal sanctity and does not create or transfer any title. In the eyes of law, the property continues to remain with your mother, and the alleged beneficiaries acquire no enforceable rights on the basis of such an unregistered document. If required, you may: - Challenge the document formally and seek declaration that it is null and void, and - Seek injunction to prevent any interference or misuse of such a document. Do not treat such papers as valid—only a duly stamped and registered gift deed has legal effect.

No, On xerox paper it is not valid. Even if it is Gift deed b/w family members also it has to follow the procedure prescribed under the registration and stamp duty law. But, it is not valid in other ways if it is executed. that should not be bound to.
