settlement among the family members regarding property on fathers name

we are four of our family,we are going to make family settlement among family members.some properties is my father name and some of the properties is my brothers name.since i am in abroad is it possible can register without my signature an my presence? please clarify the above matter thank you in advance

Sir,
you also sign in the family settlement deed, if you are not in a position to come to India while executing such settlement, then you can send Power of attorney for the same, you just execute 'special power of attorney' to this effect.

You must appoint a power agent in India to sign on your behalf. You may do so by signing the Power of Attorney document before the consul general of your country or an Indian Notary in that country. Subsequently the power agent so appointed must have to get the documents registered in India, wherever he resides.

Yes, it is possible to register without your presence. You must execute a power of attorney in somebody's favour to do it on behalf of you. The said power can be sent to India for proper validation after it is getting attested by the Notrary/attesting authority in the nation you live. Once validation is completed the partition or settlement can be effected by the signatories (your other family members and person assigned on your behalf) to sign the document.

Give the power of attorney for specific reasons for which you are going to release you property or the partition made by you specifically. if the other party is releasing the property in your favour then no power is required.
