28-Aug-2023 (In Property Law)
My father has a property from my paternal grandfather our home do my mother have a stack on it... My paternal grandparents are no more my father is threatening to sell it in one go..... Can my mother claim a stake..... Can we send a notice to prevent him selling the property without my mummy consent... What to do for it & what cost to expect??
Yes ur mother have right in ancestors property equal to ur father.
After death of ur grand father ancestors property wast equally in all successor ie ur father ur mother and you also.
If u and ur mother wants to stop selling the property by ur father then u can file a case under section 116 u.p. revenue code and take status quo from court

Hi,
Right to your mother in the inherited property is not in your father's lifetime. However, this is an ancestral property and you and your siblings would have right on this property. Your mother can file an injunction suit on the ground that the house is her matrimonial house so that father could be prevented from selling and you guys have the right to prevent selling of the house as a coparcenary right.
