Right of second wife and her child on property of married man

My father did second marriage without giving divorce to my mother (First wife) now my mother is no more. The property is in the name of my mother(first wife) now tge second wife and his son is claiming for the fifty percent of the property.. Is this legal? Please answer my question in detail.

From perusal of your query it is not clear that whether your father is alive or not. If your father is alive then after death of you mother, the property devolves upon you and your father and both of you have equal share in the property. So far claim of your step mother and step brother are concerned ,it is absolutely clear that they cannot have any legal right over the property which stands in your mother's name. For further guidance you may take consultation of legal expert.

The property in your mother's name is her absolute ownership and after her death only her legal heirs are entitled to get equal share, along with all. The legal heirs of a Hindu woman are--- husband and her children.

As per hindu law , second marriage without giving divorce to first wife is void. As the marriage is void second wife don't have any right but childrens born from second wife have right in the property.
