Right of daughter in the property of mother post death of mother

11-Aug-2023 (In Property Law)
If the property is owned by the mother and the tax receipts are in the name of the mother and daughter then does it imply that the property is jointly owned by the mother and the daughter and on the death of the mother does the entire property automatically pass on to the daughter?

No. The property only belongs to the person in whose name if is registered. Merely paying tax doesn't mean that some one become the owner. However as a successor of your mother you can claim proportionate share in the property. If you have no any fullblood brother or sister in that case you may become sole owner of the property.

Dear Questioner,
Property would be transferred only on two grounds under law. First on the basis of legal heir and Second ,the aforesaid property has been gifted by the owner. In your case mother has owned the property but tax receipt has been issued in the name of mother and Daughter, it can not give right to daughter to claim property only on the basis of tax receipt. Kindly clarify whether tax recipt is correction slip issued by the Circle officer or Municipal receipt. you have right o claim property on the basis of legal heir. Give your feedback.
