Actually one person turned civil matter in to criminal by putting 406 sec and friendly loan matter and I received the first summon date is tomorrow but till now no bail application hearing happened m afraid tomorrow first summon date..can the judge will issue nbw Tommorow

Don't worry. No arrest warrant is going to be issued till next 1-2 months and till that time your anticipatory bail petition will be heard and order will be passed on the basis of merit of the suit. Usually anticipatory bail applications are heard after getting original files from the trial court which takes time. so don't worry.



Q: Need Guidance for Property Transfer – Will in My Name

I’m seeking legal help regarding my grandfather’s property in Ranchi. He passed away recently and had written an unregistered Will naming me (his grandson) as the sole heir. My father and grandmother are no more.The house and all utilities (electricity, gas, tax, etc.) are still in my grandfather’s name. Could you please guide me on the steps to transfer the property and utilities to my name?

In case, you are the sole successor of your grandfather and there is no one to share the property then apply for succession mutation of the property in your own name presenting required documents and similarly apply for transfer of other utilities in your name individually. But in case there is someone to share the property then in that case you need to file Probate case regarding these property left by your grandfather though will, against that shareholder/ Shareholders. For that you need to met with an advocate dealing in property related matters.

Q: My property sold by another person

There was a property for which my grandfather won case against a person and got the degree from court in 1962. But he didn’t completed mutation process. But I heard, about that property few years back and now I heard, the person against whom my grandfather won case, had sold the property 2years back. What is the solution to this?

File a Title Suit in the civil court for cancellation of the sale deed executed by that person in someone else favour. The decree of the previous Suit is enough for cancellation of that sale deed. Mutation of the property doesn't provide the title over a property. It is a government register, which ha calculation of the total revenue earned by the government from the persons regarding specific piece of lands. Go and met with an advocate. Though it will take time and money both, but it will go in favour of you, subject to handling of the suit.



Q: Illegal construction on property land

We have a residential plot in Gutuwa, Ratu, Ranchi . Registry is done but mutation is not. We lately got to know that someone has illegally constructed a boundary on this. What are our options to challenge this?

You have various options, but before that you have to confirm about your title, whether it is valid, legal and absolute title or not. Similarly you also have to find out that the person who has illegal possession over your property has valid right title and interest over the property or not. Only after that specific option will be decided.
