Relinquishment deed taken by fraud

01-Jan-2025 (In Property Law)
I am an adopted child. After my mother's death, even post my marriage my father took me to magistrate office and asked me to sign a document saying he was getting my work done. I trusted him and signed. Today after 15 years I got to know he got relinquishment deed signed from me that I was ready to give my rights to him. Now I don't know was this in influence of my step mother. Any way of cancelling this document as I have been cheated.

hi for this we would have to know the exact status of the property with its documents. plus we would have to know the date of death, date of marriage, etc. it is not easy to get it cancelled but yes certainly steps can be taken to make efforts for the same.

The adopted son can consider the following legal actions to challenge and cancel the relinquishment deed, as it appears to have been obtained through deceit or misrepresentation: File a Civil Suit for Cancellation of the Deed Plead Fraud (Section 17 of the Indian Contract Act, 1872) File a Complaint for Criminal Offenses Challenge on Grounds of Lack of Free Consent Approach the Family Court Gather Evidence Injunction to Prevent Further Transfers The success of the legal action will depend on the evidence and circumstances surrounding the execution of the deed.

You can file a civil suit in the local court where you have to specify and give evidence to show how fraud was committed to you and it was done under the influence of your step mother. After the trial once you establishes that it was committed, court will order cancellation of the deed
