I have perused the contents of your query and would advise you to share the copy of the Will to enable us to advise you better on this issue. Probate is not required in case you have the registered Will. For further consultancy and legal services you may contact us.

in order to avoid probate of will we suggest our client to kindly to show documents of the property concern so that we can assertain the easiest and cheapest way to gift that property. I will need ownership documents of the property name of your father in law and details of his legal Heirs in order to ascertain the best way to avoid probate of will so that in the cheapest way you can get the property in your name without paying hefty stamp duty.

Since it is a will as you just wrote here that means you can go probate way to make it more legally accurate. first you need to tell us that what's the status of that gift deed ?? was any gift deed executed ?? if not better file for probate so as to avoid any confusion..
