Purchase from spouse who holds power of attorney of the property

I want to purchase a property whose legal owner is mother in law , but she has given power of attorney to her son ,who is my husband,for sale right of the property. Can me as wife purchase from husband legally? Does husband another brother or sister have legal rights to cancel sale deed because it is their mother property and they have right too?

Yes, you can legally purchase the property provided your husband is acting under a valid and subsisting registered Power of Attorney that expressly authorizes him to sell the property and execute the sale deed. The sale deed should be executed by your husband as attorney of your mother-in-law, not in his personal capacity.

Yes, if your mother-in-law is the absolute owner of the property and has executed a valid, subsisting, and duly stamped/registered Power of Attorney (where registration is legally required) authorizing your husband to sell the property, then your husband, as her attorney, can execute the sale deed in your favour. Such a transaction is legally permissible, provided it is bona fide, for valid consideration, and the Power of Attorney specifically authorizes the sale. Merely being the attorney does not make him the owner; he acts on behalf of the actual owner. The other children of your mother-in-law cannot challenge or cancel the sale deed merely because they are her son or daughter. During her lifetime, they do not acquire any ownership right in her self-acquired property. However, they may challenge the transaction only if they can establish fraud, coercion, lack of authority under the Power of Attorney, or that the property is ancestral/coparcenary in nature. Before proceeding, it is advisable to conduct proper title verification and verify the validity of the Power of Attorney.
