Property transferred through daana

Land was purchased through father income and got registered in mother name. My mother has some psychological issues but she acts so smartly or she may too clever that i can not prove the same. All the medical documents which were their being destroyed by my mother and shifted to native. At present she has done the dhaana settlement in the name of my sister who are very much eager to sell the property for monetary benefit. I am not sure how many witness have signed the dhana settlement. Can you please suggest how can i save the my father built temple (house) from this act. At present my financial condition is too worst because of job loss too

Usually the Dhana Settlement cannot be revoked. The Dhana Settlement is absolute in nature and irrevocable too. Unless Dhana Settlement contains any clause specifically revocable points, it cannot be revoked and your sister will be the owner of the property.

Respected Here you have one option as you infomred that the land was purchased through your father income. if you are ready to prove such facts, then your can file a suit for partition claiming that the property is of yourr father and your have equal undevided share in the said property. In the said parition deed you are required to prove the source of income to purchase the family property and also required to sought for gift deed is illegal since the property is joint family porperty. required detail discussion. if interested contact us. via Law Rato

You have to first obtain copy of the document of purchase (certified) and similarly copy of gift deed if your mother bos already gifted it to your sister and bring them to me. I will take up the matter in Court, .
