property (shop in commercial complex) maintenance issue

the builder appointed maintenance agency for last 8 yrs is asking exorbitanr charges without any accountability to shop owners.most oeners have not paid for last 4 yrs and are not allowed to open their shops 1.what remedy do we have 2. does law of limitation of 3 yrs apply here (builder has not sued as his illegalities would come before court)
