Property issue with my sister who already got her property share room

I am having property (Room) in Ulhasnagar where my Father and Mother was staying but after my father's death my sister is staying temporary with my mother and with her husband. My father purchased rooms for my brother and for my sister after their marriage. After my marriage I am staying in rented house. Before father's death my sister sold her property (Room) and staying with my father due to his health issue. Now she is not leaving that room which is mine as my mother gifted or sold that property to me and she is staying with me now. I have changed light bill and property tax bill in my name. Kindly suggest how can I tell her to leave my room as she starting verbal argument every time when asked her to leave room. Property was purchased by my father in my mother's name but property is in chawl so not registered.

If the property(room) is in the name of mother, than I think u should get the document called DEED OF GIFT registered even if it is in chawl. After u acquire ownership rights through a registered instrument u can file a matter in court for complete possession as u are the owner of the said room. Chawl rooms also get registered and now from April Stamp duty is Rupees Five hundred and Registration is Rupees Two Hundred only.

you have not explained many things in ur query. whether your mother executed gift deed in writing in which she gifted this room to u only? is there any condition she put allowing your sister to use this property for certain period? how did u change the name on electricity bill n property tax bill without ur sibling's consent?

We need to understand further facts from you. Basis your facts provided, your Suster has a equal right aa you in the parents property. In case the parents are aware of the precious property already given to your sister, then they can Gift you the property as of now or write Will and register it. The same can be done to resolve your situation and your family can arrive at a settlement accordingly.
