Property Issue Related To Incomplete Building

27-Dec-2024 (In Property Law)
I had purchased a builder floor in Uttam nagar 6 months ago. Registry is done and we have taken the possession. But the builder had left the building incomplete and there are many pending issues like installation of lift and clearing the parking stilt area. Please suggest a legal recourse. Thanks.

Since the builder has failed to complete the promised work, following steps could be taken: 1.Send a legal notice to the builder, demanding completion of the pending issues within a specified time. 2.Pursuant to the notice, if builder doesnt complies with demands file a complaint with RERA or Consumer Forum (as the case may be) to hold the builder accountable.

You can file a suit for mandatory injunction against the builder to compel him to complete the remaining work and you claim compensation too for the delay in work completion. you can also suit for Recovery of money or cheating & criminal breach of trust too.

outlining the pending issues like lift installation and clearing the stilt parking area, demanding resolution within a stipulated time. If the builder fails to act, file a complaint with the Consumer Forum for deficiency of service or approach RERA if the project is registered, seeking completion of work and compensation. As a last resort, consider a civil suit for specific performance or damages. Joining other buyers facing similar issues can strengthen your case. Let me know if you need assistance drafting the legal notice or filing the complaint.
