Hi There is a property developer selling villa plots saying its BIAPPA approved but I don't see any approval no. and developer is saying that the documents and details will be shared after paying the booking amount. Is there a way to get this refunded if the booking is cancelled? and what is the legal process to get it done?
you either convince him by giving a post dated cheque and getting the documents and go for it only after verification by a land specialist lawyer. If he insists on payment , convince him for small payment and get a valid receipt with a condition that he should return that amount if project is found to be not approved.
As per the provision of Real estate regulatory authority legislation the developer has to provide the rera registration in advertisement before paying only if anyone is not doing so then you can file rera complaint against that developer or builder or promoter or anyone who is selling the property for the first time
