procedure to write a will transferring property under someone's name
16-Aug-2023 (In Property Law)
Mom and Dad had worked hard together and have built a house and had deposited an amount under fixed account. At the time of deposit, as there is only one possibility of adding only one name as nominee, dad added Mom's name. After the death of Dad, Mom, made my brother as the nominee. Now he is ill-treating mom, and hence she wants to write a will stating that the house and fixed deposits to be transferred under my name. Is that possible as she is unable to walk. Also what are the repercussions which can come from my brother end.

Nominee is different from legal heirs. After the death of your father she can acquire the property as per the nominee. Now the property divided into three parts for your mother, your brother and yourself. So that after Partition, your mother can make a will upon her will and interest. Your brother entitled for 1/3rd share.
