Procedure to get share in the property which is already sold

We are joint family that time we purchased land on my father elder brother name. But he sold to someone back 15, can we get a share on this now

You can claim if you have any documentary proof to show that property was bought jointly and you all shared the cost of the land equally. Otherwise, it is difficult to claim and there is also a time limitation to claim. Pl contact me if you need further clarification. Thanks

As per the details given by you it appears that your father purchased the land in his brothers name . It is not a joint property because your father might have purchased it with his self acquired funds but as per records your fathers elder brother is the owner . It is very difficult to establish your rights over the property because it was his self acquired property .

You can file suit for render accounts for it. After 15 years you cannot file suit and there is no limitation. You have to issue notice to your father's elder brother and get adequate details and then file suit.

Within three years from the date of sale you can file a suit for declaration that the sale deed executed by your father s elder brother in favor of the buyer is null and void and consequentially ask for partition of the property . Make the buyer also a party.
