Procedure for share in grandmother's property occupied by step mother

12-Nov-2023 (In Property Law)
My father has expired on 08/11/2017 leaving behind 3 married sisters and a step mother with no child. We came to know during Cremation that our step mother has entered into an agreement with a builder for construction of an apartment without our knowledge on his property. Can we stake claim.? The property was in the name of my father's mother. My father is the only child.

Yes you can stake claim. In your case you are 1/4 part owner of the property I.e the property is to be divided equally among all 4 of you, who are living heir of the predecesed. You or all three of you can file a title suit claiming your share of property in your district court and serve the copy to your step mom. Now as the property becomes litigated no one will buy it or develop it until all of you come into some kind of agreement... if you have further queries contact me through lawrato...

Madam,
As the property is in the name of your father, after his demise it it devolved into your 3 sisters and step mother. Each of you have1/4th share in the property in undivided form. This you all have equal rights.
The developer can act on the signature of your step MOTHER'S signature alone.
In the mean time you 3 sisters make arrangements of the deed, parcha & municipal receipts. For your future legal battle.
Thanks

After the death of your father his three daughters and his wife inherited the property equally (1/4th share) each. If your step mother entered into an agreement with any 3rd party then you have to object to enter her and finally you have to file a suit.
