Procedure for partition of grandmother's ancestral property equally.

My grand mother died 2 months ago.As my father used to work in Odisha my grand mother used to live with my uncle (elder brother of my dad).My father has retired now and came back to our ancestral house with my mother one year back. Now seeing the attitude of my uncle we doubt he might have got the property written in his name by my grand mother. If our assumption is correct then according to Indian law can my parents get their share of property?my grandfather died long ago. I live in kolkata and is hindu by religion. I am married also and only girl child of my parents.

Dear client
We cannot tell anything on the basis of assumption.we have to verify it from the concerned department.If your uncle did anything against law you can file civil and criminal case against him

First you have to do search as to find out the status of the property.
Do the search in the registry office under whose jurisdiction the said property is situated.
If you find any such transaction then obtain certified copy of the same and file a suit in the proper court challenging the said document.

If the property was in the grandfather, then the matter is easy for you. The only thing that your uncle can made is to transfer your grandmother's share in his name, but, the share of your father is existing.
Do not leave the property.
