Paid advance towards purchase of site, owner is not returning money.

Dear Sir/Madam,
we paid advance towards purchase of site in 2020, later we decided not to proceed further. However the owner is not returned a rupee till now. I filed a compliant in Jul2024. Can i proceed with cheating case against him, he always saying that this is an civil case cops are not interested in this case. Please let me know can i file Cheating as well with civil case. Looking for your support.

based on your question, if the owner not to send money you can lodge FIR against the person, collect all the documents for evidence which support your case.

there is a problem with regard to recovery of money, for any recovery case in Court the transaction in a way should not be older than 3 years. so I have to check the agreement that you made with that owner to tell you anything further.
