Over rule Public Notice to Debarred Son(alive) by Father(deceased now)
31-Jul-2023 (In Property Law)
Property is owned by Father (not ancestral). Legal heir resides in the property now. Father died 12 years back with NO WILL. Hence, its a disputed property now.
Now there are allegations from my brother, that I was debarred by my father before his death by issuing public notice after a court case. However, he denies to show me any related document. To my knowledge we did not receive any such public notice. Also, i & my family (wife & children) have been staying in the same property paying electricity bills in my name. My question is:
1. How to ascertain whether his Allegations hold true.
2. If allegations are true, am i not entitled to get any penny from the sale amount of the property?
3. If allegations are true what is the procedure to over rule this by moving into court.
*straight forward answers only please
I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise. You are advised to issue a legal notice seeking information and documents pertaining to alleged debarring. Further an intallah peshbandi be filed with the concerned police authorities.

A civil suit for partition should be immediately filed from your side claiming your share in the undivided property. If your father had died intestate, you will get your particular share out of the same.
