If someone had an FIR and gone jail for 15 days I want to know 2 things1 can he is eligible for civil services???2 can the case will be closed forever???Because the police didn't send the charge sheet yet it had 3 years the case was fully fake and charges was wrong like ragging ,307 and many things And police also not present the victim is 24hours to the magistrate plz help what I should do???

Advocate DhananJay S. Sehrawat answered
Yes he is eligible for civil services but he should not be convicted for any offence and at the end of the trial the acquittal should be honourable acquittal. The police has to present the accused before the magistrate within 24 hrs not the victim.

Q: Fir radd kese krwaye 325 dhara lago ho toh ??

Sir mere khilaaf 325 ki dhara k tehat FIR ki gayi hai case ko 15 din hone ko aaye abi tk koi notice etc nahi aaya na IO ne bulaya but jinhonne complaint ki thi woh keh rahe hai samjhauta kr lete hai pr FIR mae samjhauta kese kare? Pls help

Advocate DhananJay S. Sehrawat answered
F.I.R hone ke baad samjhauta krne ke liye F.I.R quash krwani padti h high court se. Agar apko apne khilaaf hua case khatam krwana h to quashing ke liye high court mein quashing petition file krni padegi.

I have understood your situation to an extent but any lawyer would require your assistance on the facts stated in the F.I.R and chargesheet, the same is with me. That would be the deciding factor to contest your case.

Q: Bail for Non-bailable offences.

If any possible to give a bail order to non-bailable offences such as 302, 307 IPCs on Public holidays in the Subordinate Courts.

Advocate DhananJay S. Sehrawat answered
There are specific provisions for women and children but for men, there has to be a specific situation which cannot be dithered and it has to be established before the court. And for the present situation, hearings are being conducted through video conferencing only

Q: Can wife file 498A after DV Act is filed and contested

I got married in Dec 2014 and after 6 months, she left for her parents home. Tried various things to settle it. After two and a half years, I filed a divorce case on the ground of desertion. Before accepting the summons she filed DV Act. And now, DV act case is at the "Final Order" stage. Everything is recorded and there is no mentioning of dowry in DV act statements and crossings.I am already paying maintenance. Can she still file 498A if DV act comes in my favour?

Advocate DhananJay S. Sehrawat answered
Yes she can file a complaint in 498 A and FIR can be lodged against that, but the same can be quashed in the High Court being an after thought and this ground can simply be established as substantial.
