Opposite party trying to cancel the sale agreement

Hi Sir, My dad bought a house for 155000 in dharmapuri in Dec 2015. He paid 150000 and got sale agreement on his name. Right now the opposite party is trying to cancel the sale agreement and they are cheating us that they are not ready to sell right now. Right now we are leaving in that same house. Plz suggest on this shall we put stay order on that and pay reaming amount and register the house. Plz suggest.

File a case in the proper court that the opposite party should not alienate the property and not to disturb the peaceful possession of your occupation and this is the only remedy that the other party will stop his illegal sale.

It depends on the terms of the sale agreement and find out what it says and when the balance amount has to be paid. consult an advocate and get a stay order if the seller has violated the terms of the agreement and pray for getting the sale deed in your fathers name.

You have to file a civil suit for specific performance to register the property in your name,and to show your ready and willingness,by offering the remaining sale consideration ,by way of bank qurantee to the court

Yes. He is bound by agreement of sale. Hence first issue a notice to him that you are willing to make the remaining amount towards sale consideration. in case if he does not respond to your notice consult a lawyer and file a suit for specific performance.
