Nuisance Caused by Our Neighbor
14-Oct-2024 (In Property Law)
We are a family of four mom, dad, elder sister, and me and we own a house in a decent locality. We prefer a peaceful life, but our neighboring family causes ongoing issues. They wash their vehicle in front of our house and deliberately clean their staircase so that water flows onto our property. When my dad raised these concerns, they responded with threats. They also throw garbage in front of our house and one member even eve-teased my mother. All the neighbors share similar frustrations

Protecting private property is a fundamental legal right that individuals are entitled to uphold. If someone believes that their property rights have been violated or that there is a dispute concerning ownership, they have the option of taking legal action. One of the first steps in this process is sending a legal notice to the party involved. A legal notice serves as a formal communication that informs the other party of the issue and outlines the property owner's concerns and demands. This notice provides an opportunity for the parties to resolve the matter amicably before escalating the issue further.
If the dispute is not resolved through dialogue or negotiation after the legal notice is sent, the property owner has the right to question the actions taken by the other party and seek appropriate legal remedies. These remedies could include compensation for damages, restoration of ownership rights, or an injunction to prevent further encroachments or violations. By following the legal procedure, individuals can ensure that their property rights are respected and protected under the law, giving them a structured path to seek justice if their rights are infringed upon.
First you need to have to file a complaint against your neighbour, visit to the nearest police station and file an NCR, stating all the details about troubling and eve-teasing your mother and include the details about the threats and when they are continuously throwing garbage in-front of your house then make sure you make proper video then visit your nearest BBMP office then give a written complaint to the JC (Joint Commissioner) and get an acknowledgment of the complaint, then they will impose appropriate fine on them.
Even after taking all the above steps, if they are repeating the same send a legal notice through an Advocate.
