Depends on the lease deed with the govt. You are advised to meet a lawyer with the lease deed and if need be to conduct a searching of the title deed through your lawyer. That should be as much safe as you can be.

dear client,
As the details in your question is insufficient to answer even though before purchasing the flat you have to legally check all the title deed pertaining to the said flat as there has to be clause of sub letting or sub leasing in the said lease deed only then you can get the lease of the flat.

In this you can buy only the lease hold interest of the said property and lease deed of the seller need to be carefully looked into as to what are the terms of the aforementioned lease...

Basically there is a difference between leased hold Property and owned property.First you check from the concerned Government department about the current status of the property and whether the seller is entitled to sell the referred the Property.Once ownership Of the seller is verified you may proceed further in the matter.for further instructions contact lawRato.
