Manage property as divorce case is already filed

04-Oct-2026 (In Property Law)
Divorce filed in 2014, flat purchased after filing divorce in 2016 and divorce is still pending. I want to save my property from alimony case/ situation and want other options like making trust or transfer property to other known person like that. Overall I want to show my finance status as it was at the time of filing divorce case. As I m working in same company since last 15 years with no significant salary hike.

Since the flat was purchased after the divorce case was filed, it is not automatically excluded from consideration; the court can examine your present assets and financial capacity while deciding alimony. Avoid sham transfers to relatives/trusts just to defeat an alimony claim; instead, maintain genuine records showing your income, liabilities and financial position since 2014, and explain that your salary has remained substantially unchanged.

If the flat was genuinely purchased after the divorce petition was filed, that fact can be strategically important—but the exact effect depends on who paid the purchase price, source of funds, title, loan/EMI, date of acquisition and the applicable matrimonial law.

Hey, this seems like a good topic of discussion.. could we get on a call and probably discuss about how many blood relatives including parents could we involve to make this happen? Technically if you’ve bought a home even in your name is until the pendency of the petition, an asset of both husband and wife depending on if she’s a home maker or she works.. But of course there’s ways..

alimony amount depends upon your income, your expenditure and expenses on your dependents property transfer by making trust or other known person rather than more risk to show to your own property, or unnecessary create legal issue with transferry, misuse the property and other... so it is better way to decide matter as early as possible or settled matter amicably or direct approach to opposite party and settled matter...
