Legality of GHMC's Partial Demolition Despite Speaking Order

17-Jul-2026 (In Property Law)
GHMC issued a speaking order directing removal of the unauthorized compound wall after the encroacher failed to produce any valid documents and had no order from any competent court. However, GHMC demolished only a small portion, leaving most of the unauthorized wall intact. Was GHMC legally justified in carrying out only a partial demolition, or should it have removed the entire unauthorized structure?

hi if they had only demolished part of the building and not taking any action on the other portion then you could approach the Court seeking for necessary relief from the Court and see that construction be cimpleted

If GHMC passed a speaking order directing removal of the entire unauthorized compound wall, and there was no stay order from any competent court, it was expected to implement the order in its entirety. Partial demolition, without any legal justification, may amount to incomplete compliance with its own order and failure to discharge its statutory duty. In such circumstances, the aggrieved party may seek implementation of the speaking order by submitting a representation or by approaching the High Court for appropriate directions to ensure complete removal of the unauthorized structure in accordance with law.
