Legal validity of legal notice sent without lawyer

Dear Sirs, I wish to send a legal notice asking the tenant to vacate. Is it mandatory to send the legal notice through a lawyer? Can I myself send the legal notice without a lawyer? Does it have legal validity when I file a civil suit later? If I send a legal notice through a lawyer, is it mandatory to hire the same lawyer for civil suit also? Thank you, sirs. Regards.

Though you can send a notice to a tenant to vacate by yourself. But is always advisable to send it through a counsel to avoid making any assertions and statements that may prejudice your rights in future. Also it may be possible that the other party may use it as a defence/action to their claim if any unnecessary or unwarranted statement is made. You may consult different advocates for notice and further action but again it is advisable to go with the same counsel. You may consult with us for initiating your notice.

Hi there, it's not mandatory to send the notice through a lawyer only you can send on your own. However, a LEGAL notice sent by a lawyer has more impact than notice sent without a lawyer. There is no compulsion to retain the same lawyer in a civil suit, you can hire a lawyer as per your own convenience. If you have any questions feel free to contact me.

A legal notice to vacate tenancy is not mandatorily required to be sent through a lawyer. The law does not prescribe that only an advocate can issue such notice. A landlord can personally issue a notice terminating tenancy, provided it complies with the applicable law. If a lawyer issues the notice, it strengthens drafting quality and reduces technical challenges, but it is not legally compulsory. Further, if you engage a lawyer for sending notice, there is no legal obligation to engage the same lawyer for filing the civil suit. You are free to appoint any advocate of your choice at any stage.
