Inheritance/Property transfer for overseas relatives

I live overseas with my children. My husband, resided in Delhi, has recently expired. His family is not supportive of us. I'm travelling to Delhi to file various inheritance claims on behalf of my children. What sort of NOC or other documentation should I get from my children for these legal processes?

you do not need to get any NOC from your children. if anything you can get a power of attorney in your favour which will be executed by your children wherein they will give you the authority to deal with the legal processes on their behalf. for further queries please feel free to contact

You need to apply for legal hier certificate wherein name of all the legal hiers will be mentioned with photographs. You need NOC and affidavits duly attested from your children. Further for filing succession certificate or letter of administration you would require POA

Hi you can either make your children part of the legal process my additional plaintiffs as they r necessary party and also take Power of Attorney of them if they r major other wise if they r minor you r their Gaurdian so no doc required you can discuss the details We deal in partition litigation etc for many other overseas clients also you can connect for details

As you are coming to file some suits on basis of your children who live in other country so it will be better if you take their power of attorney is attested by the embassy of that country because on basis of that attested power of attorney means you will be able to file suit in India and it will help you in all the process

We have to see how old are the children? If they are major they can give noc but otherwise they cannot and then a legal Guardian will have to be appointed first and the guardian will then give noc on their behalf. You can file the case on their behalf by taking courts permission. In case children can’t come along they need to give their POA attested from embassy to you
