Illegally transfer of property

My father's 15 gunta of agricultural land has been transferred to his younger brother by panchayat village accountant through unregistered deed...how can we get back our property legally

well as soon as the matter comes to our notice you have to raise a dispute and file a case making his younger brother also a party to the case. now if the matter is within jurisdiction of Bangalore urban or rural district I can take up the matter

Respected As you informed there is Panachayth Transfer, need when it was transferrd and how it was transferrd. Normally there is a time limit under law to challenge the illegal transfer. If the transfer is within the time limit, your father can challenge the same before any court of law. need discussion to answer in detail to your queation. you can contact us or contact any reapective counsel.

If you look at selling the property because your spouse isn't a joint owner then there is still something they can do to try and block you from selling the property your spouse may apply for home rights in order to gain permission to stay within the property, which will obviously mean you will be unable to sell for a period of time. If your spouse has paid towards the mortgage they can apply for the occupation order to remain living at the property, which again if granted cannot sell the property.
