I am facing a Property Dispute in Bangalore. Please help me out

05-Sep-2023 (In Property Law)
Hi, Before my father-in-law passed away he made a will to transfer his property to my wife's name. She is the last daughter. There is a BDA site which was de-allotted and some FDs. With the legal will she was able to get the FDs and rented house advance transferred to her name. BDA site is not yet allotted. In meanwhile her bro. and sis. have sent a notice that property needs to be shared and that will was done by force. Can you suggest what needs to be done. Initially we ignore but we received another notice which we rejected.

First we need to know wt they have sent in d notice. They might have filled case against the will. That has to be suitably answered otherwise they have chance to cancel the will in Ur absence. So it's better to answer

You have to check whether the property owned by your father-in-law was self acquired or ancestral property. If it is self acquired then he can execute Will as per his wish whomever he wants. Meanwhile you have not mentioned his health condition while executing the Will, whether he was healthy or ill or in a sound mental condition to execute the Will has to be clarified. If your wife's sibling are alleging that the Will was executed by coercion or force then they can file a suit for partition and its their burden to prove before the court. Hence, whatever property which is mentioned in your wife's name in the Will executed by your father-in-law will come to your wife if the Will is genuine. Consult any advocate.

always your wife will prove the genuine of the will (which is registered) with all contents of the will. I think you may face civil litigation in Bangaluru civil court by other broyhers and sisters. At the same time you are may sitting with them and compromise or peaceful settlement is best way last resort for good relations.
