I am facing a complicated Land Issue. Please give appropriate advise

3 acres Land is been their since last 20 years to till in my Fathers name, and father also has divided to me and my brother.. After divided we didnt change the name /make it to our name, when recently we gone to make PANI to our name that time we came to know that someone (Uncle's sun) has already raised a complaint 3 years back against land that my uncle also having part in it.. And didn't qttend court (we ignore all the notices) because we know that its ours hence we didnt attend court... Pls confirm how come uncle is having part and last 20 years the Pani is coming to my father's name only, and when we want make this our name, this was the concern, and now unnessasary delay to make land our name from father's... Pls confirm how to close this issue.

The fact that the land continues to be in your father name does not imply automatically that now it has to be transferred to you and your brother. If your uncle son has filed the suit challenging the title over the said property and even after receipt of the summons from the court if you have failed to appear and defend the claims put forth by your uncle son, then you must start by participating in the said case and seek for reference to mediation, there sit across with your uncle son and find out the best possible way to close the issue. He has filed the case for purposes of extracting money from you, sit with him in mediation and sort out the differences.

Your fatal error is ignoring the notices as land is yours. One the contrary if you ignore the notices it gives adverse impression, as if you are treating that Court don`t exist, while you should have attended and defended your title and and court may have given a share to your uncle or may have dismissed the case. Find out.

You have mentioned that you have not attended the court in which your uncle has filed a suit. First check in the concerned court whether any order has passed in that case by contacting advocate who will help you out to know the legal status. You have not mentioned when your uncle has filed case and what kind of case he has filed for ? Though your father's name may be displaying in Pahani or RTC but you have not mentioned whether the property is ancestral or self acquired. There are lot of issues involved in your incomplete question so please contact us.
