I am eligible for grand father's property partition?

My father was expire on 4/8/1981 and my birth on 14/02/1982 and my mother was get married after my father's death can I eligible for legal partition of my late grand parents property if they are against on me

You will not be eligible for the partition in your grand parents property because since your mother is remarried after your father's death and has gone to different family and also you belong to that family in which your mother is remarried, so you will be entitled to the partition of family in which your mother is remarried.

If the property in hand is a coparcenery property,you become coparcener by the birth having the right to inherite and partitioned the property.Even your mother is also entitled for the same.Your mother's remarriage is not at all legal impediment to inherite your father's share.If the property is self acquired then it is upon your grandfather's wish to dispose of the property.

Since you were in womb of your mother at the time of demise of your father, hence you become coparcener in ancestral property of your father by birth. So you may claim share in coparcenary property by filing civil suit. For more specific reply you may contact me details of your case.
