How will grandfather's property be divided amongst sons and grandsons

21-Oct-2023 (In Property Law)
I’m from Hoshiarpur (Punjab) & I live in a joint family. My Father has 1 elder brother & 2 sisters. My Uncle have 2 sons one of 37 years & other of 26 years. We are jewellers by occupation & we own 2 shops. My grandfather started this business. My grandfather left us in 1982.On one shop my father sits & on other shop my uncle. The elder son of my uncle sits with my father from last 17 years. The second son sits on both the shops on alternate days from last 4 years.I’m 18 years old & have started taking interest in business from last 7-8 days. Nowadays we have disputes among our family members & both the families want to separate from each other. When we sat for the distribution of all the assets, stock, properties etc. numerous disputes took place. My father told to divide everything in equal ratio between their brother but the both sons of my uncle said that they also want some percentage of the assets. So what should we do now?

Dear Client,
The property as explained by you is a joint family property. It will be divided or partitioned equally between all the legal heirs of your grandfather. If your grandmother is alive then, one share will also devolve upon her and one share each to children of your grandfather. If your grandmother is not alive then property will be divided among children of your grandfather in equal shares. If your father and uncle have any sisters then she/they shall also get equal share as your father or your uncle will get. otherwise of no sister's, then only your father and your uncle is entitled to equal share. You have to file a suit for Partition in Civil Judge ( Sr.Division ) Hoshiarpur. So, consult any lawyer in Hoshiarpur. Even I am Also from Hoshiarpur, You can also consult me.
Thanx.
