How will fathers property be divided ?

Hi, We live in joint family in Delhi. Our property is in the name of my grand father. He wants to give his property in equal share to his both sons.As per today’s market the value of the property is more than 1cr. Bt the younger son wants give Only 40lakh or less amount to his elder brother and want him to leave the property.And he emotionally blackmails his father and mother to transfer the gift deed of this property in his name. As the property is not in a condition to live in.so elder brother decided to live on rent for few months until property get sold out. By unable to move because younger brother trying to take a title of whole property. Please advise what to do in this kind of situation as we want to leave this property before getting it sold . Thanks

You can make it declared in your favour..
as you have equal rights in the property
as compare to other son

U may go for registration of will executed by your grand father in favour of both of his sons on equally undivided share in whole property or you may get a sale deed executed in your father's name with 50 % equally undivided share in the whole property.

Hi,
First of all tell me if your Grand Father is alive... if it is property acquired by him then none of his legal heirs have any right in it till his life and if he wants equal division after his death he can execute a will. for further information or query you can contact me.
