How to sell property disputed between siblings?

Once an old man sell his property to his son and after few days of selling the property old man also make will of the same property in which he marked nominee to his daughter. His daughter filed case against her brother after receiving of same will after death of her father. Old man's son sell that property to my father. Even his son did not tell us about the dispute. The case was filed in the district court. After 8 years , district court puts the case in favour of old man's son. Now his daughter files case in the high Court. In which she said that she want some time for showing some more witness, due to which the case is now on hold from two years. We want to sell this property but due to their case we can't do anything. We can't able to sell that property and not can remodified the same. Please suggest us what we have to do.?? How can we overcome from this problem ?? What is the legal way to sort out this matter as soon as possible??

Dear Querist,
In the given circumstances you may sell this property to the son from whom you have purchased the property with the leave of the court. Other wise you cannot sell this property to any third party as nobody would buy this property under dispute.

As per the case here in hand the daughter must have filed an appeal against the judgement which was in favour of her brother and the same appeal is pending for the last 2 years in the appellate court. Its is immaterial to discuss the facts of the original case here so for your query is in a relation as to the time period as well as what remedy should be available to you. Till the time the matter is pending before the appellate court you can not sell the property and even after the finality of appeal it depends upon the judgment of appellate court.

If there is any chance of settling the matter amicably then it would take much less time than in court's decision and till the dispute is resolved, you cannot sell the property. in court you can make a request to kindly dispose of the matter at the earliest as hardships are being caused to you. Next time when you invest in any property then You should diligently research about the property.
