How to get possession of property if builder is delaying construction

Sir, I bought one flat in under construction in building. Now builder has stopped construction in this building . He is telling that he has no money . Almost all people has paid 90% amount . Remaining work is around 10% and builder is asking from us to pay remaining 10% for completion of work . Builder is not trustable . We are afraid that if we pay remaining amount to builder then builder may run away. Now 50% buyer are in contact with us .We are unite . We all want to complete the work. We are ready to pay money but step wise.We all want to formulate a system in which builder can not take money from bank account without our approval . We want to complete remaining work under our monitoring . How legally we can make a system to complete the work with full transparency . Builder is also not registered under RERA.
Apply to rera , and from there get an order to hand over the possession to either individual buyers or society of buyers, and then get yoyr self the remaining work completed. No role of builder is foreseen, unless lack of permissions is revealed.
As far as the construction / real estate is concerned you should be happy if your builder speaks you. in fact it's very tough time for them. You will not get anything if at all think to proceed for any legal action.
Sir, there are many provisions under law we can file a civil suit and takeinjunction and ask builder to deposit the security amount before the court.,, we can also file complaint before the consumer forum Court we all violated parties can jointly file a criminal FIR against the Builder we can also issue letter regarding that not to release the amount stating all the conditions for further more information just contact us
Builder is not registered but you will complaint against builder before RERA, You filled complaint online against builder U/p of RERA.
