How to get back registered property back from relatives

My father had received some land in Kerala, after division of the ancestral land between him and his siblings. When the land was divided and registered in individual's name, he was in good terms with his siblings. Hence the registration papers of his land were kept with them, i.e. in Kerala, whereas we are living in Ahmedabad. But later on due to some family issues, the relations went soar. Now my father has expired, but the land's registration papers are still with his siblings in Kerala and they are not returning it to us. I want to collect those papers from them and hand it over to my mother. Kindly advice, what should i do in such case. Also let me know, if it is possible for them to acquire or sell my father's land without our knowledge or consent.

You can ask them to return the papers by serving Notice through an advocate. A better option would be to get the certified copy from the concerned Sub Registrar's Office. A local document writer can do the work done without too much of a hassle. There need not be any anxiety as to your father's siblings selling the property.

You can send a legal notice to your fathers sibilings regarding to hand over your fathers document. If they are not ready you can approach the court.As per law the property cannot be dispossed without the knowledge of the party.

If it is a registered document, you can get a certified copy of the same from the concerned Sub Registry Office. Since it is a family property, it might be a common partition deed which has to be kept for the use of all parties. Sometimes duplicate deeds must have registered for individual use which you can demand from the relatives. All those things can be decided only after going through the document only. Therefore it is advisable to obtain the certified copy, which can be obtained by anybody.
