11-Aug-2023 (In Property Law)
We have a ancestors land of around 1.5 acre ,which is already distributed along each other by the original property owner before 50-60 year ago and we all were doing cultivation as per the distribution till the last month but now few person who are the legal hire of the property want once again distribute the land freshly and now they are saying we will consider that distribution and earlier our grandfather who were six brothers has not done any documentation for this and I have already sell one land as per the earlier distribution. We are Hindu family. What should we do?

Dear Questioner,
You have one option to contest the case and/or stick on the then oral settlement. In such a situation you have to show that previously settlement had been done and on the basis of this all settler are enjoying right and title over it. You have sell your right so no need to worry about sell property. Give valuable feedback and free to call for more legal aid.

You need not worry much

In whose name is rent receipt being issued.if it is issued in ur name as per share...then it confirms oral partition.
Or else you neEd to prove oral partition.
At present see what is being done by them

If the partition was done in the past and no documents available to prove that then in that case someone can take shelter of the court for partition. As you said that some part has already been sold by you before any claim of partition. In that case you have not to worry . Since no one had objected at that time they will not say that the sale was illegal however they will ask for deduction of that much area of land sold by you from your legitimate share out of your total share.
