How to cancel registered home sale agreement

I had sold a flat in Mira Road. The buyer paid 30% out of the total agreement value. The sale registration is done. There is clause in the agreement that the agreement will be cancelled, if remaining payment is not done in 2 months. 12 months have passed and the buyer is not paying the remaining amount and is making excuses. He is not ready to come to the registration office for cancellation. How do I get the registration cancelled? How much will be the cost?
please send legal notice through Advocate immediately. In the Legal Notice, you will have to give 2 weeks time to the purchaser to pay back the balance money else you would file court case for cancellation of the sale deed. Once he gets the notice, the purchaser will surely make the balance payment !

You need to inform the buyer for the cancellation of agreement and then subsequent to that both of you i.e. the buyer and the seller need to go to the registration office for the cancellation of sale agreement.

1. The registration should not have been done if the full payment was not made;
2. Nonetheless you have a clause, now you can send him a legal notice;
3. Ask him to come forward and pay or cancel the registration;
4. If he still does not listen then file a police complaint for cheating;
5. If the problem still persists then file a suit in the civil court for specific performance of contract and dissolve the sale transaction;
6. Take legal steps otherwise the period of limitation will start running against you.

Sirji u have to engage an advocate for it. U have to gave anotice to the buyer through an advocate to call upon him to purchase the property. If he fails to act upon it then u have ti publish a notice in news paper. All the charges will communicate a lawyer to u.
