It is not only the sibling living in the home that has the right, but also the heirs. A court order can force someone to leave their home, but it is a severe measure and there must be a compelling reason to do so.

Can my sister claim in our father's property?

The fathers inheritance and the property acquired by the son (brother), as well as that of the daughter (sister), are equally shared between the two. It does not matter what the marital status is of the sister (daughter). The Amendment in Hindu Succession Act 1956 took effect on 09/09/2005.

You can ask the sheriff to help you evict your brother or sister if the court has granted you possession. You must understand that evictions are a legal procedure and require patience. There are no shortcuts. 14-Apr-2023

Hi,

In query, the facts are not fully clear, as to the purpose and nature of the power of attorney she require. And which all properties she need it, whether entire property or some portion of the property of the father! It is better to execute an agreement in between you, sister and your father (if he is alive) and other legal hairs stating all these facts and purpose, and to register it, if possible.
If your father is alive better advice your father to execute a will stating all these facts and purpose, and to register it, so that you can avoid unforeseen issues in future.

The facts posted are confused. Taking or giving power of attorney does not, in the normal course, does not amount to conveyance of property. Your father, during his lifetime, can dispose his property at his discretion unless it has been ancestral. You, as the son, has no special rights or entitlement.
