House sale of extra construction not reflected in BBMP TAX what to do

I am interested in purchasing a house 2500 sft build on 1200 sft land. On scrutinising document it was noticed that building permission is taken for 6sft ground and 6sft 1st flfoor. But he constructed 10 sft in ground and 1st floor and 5sft on 2nd floor. He is paying tax as per build plan of 1200 built up area. Should I ask him to update the build up area before aggrement, sale deed. He says no one will check this. just keep paying at old rate. please advice me what to do.?

You can show the measurement as per old document only, otherwise you will face problem in getting khata in your name for it after you buy. What you can do afterwards is something that cannot be told here. But pay him a little less for the mistake.

You may have to face trouble from concerned Authorities if you purchase the building which is constructed in violation of municipalities act. Ask him to regulerize the violations by paying penalty and proper fees and also ask him to enter the actual built up area in the khatha extract before entering sale agreement.

Please proceed. The builder cannot say "no one will check this" because in future if some bad situation occurs, then the builder will not answer. At that time you will be the owner.

Before to proceed to purchase of the said flat, please clarify yourself with all the legal necessities from the builder. Other wise you may face problem.

Please contact any advocate nearby you along with the papers and he can assist you.
