Hi, Can anyone please advise on how to do property(house) partition if the house is in the name of my deceased grandmother. The property will is in the hand of my uncle who is behaving rude with my father and other family members. If my father asked for the will he is behaving arrogant. We total are 8members in family and father's sister is married. Our house consists of 5rooms (including bathroom) in ground floor and 4rooms in first floor(including bathroom). My uncle occupied total 5rooms(including kitchen) and my father occupied only 3 rooms(including kitchen). Now uncle is not letting us to enter 2 common rooms in the house which was occupied by my uncle forcefully. If we asked for partition they are denying and behaving rudely with my father. They are forcefully occupied 2 common rooms in the house. Is there any way to do partition forcefully in the house if they take 1st floor and let us use the ground floor. They are not letting us to view the property deeds if asked for.

If amicable partition is not possible, then living notice thereof filing of Partition Suit will be legal option but before that Legal Heir Declaration is essential. If you wish to take my Legal opinion professionally upon online payment, then can contact.

yes you need to file for partion suit if your uncle is not showing the deed papers then court will ask him to show if you file suit in court for partition he has no right to forcefully occupy extra rooms

in my opinion you can obtain certified copy of the property deed from the office of the registrar. But without detail discussion proper consult is not possible. so, proper consult possible only after detail discussion
